Legal Question in Consumer Law in India

Sir the issue is as follows:

I and my brother booked ticket online in Irctc(both passenger in one ticket). On the date of Journey, my brother could not come and it was already late to cancel his ticket online. So he filed TDR for his name alone and I boarded the train. To my surprise the TTE said that both our tickets are filed for TDR. There was nothing mentioned in the chart he was holding but he had scribled something against our PNR number. I exlained him that onlymy brother has filed TDR against one passenger alone. But he was not ready to listen to me. He asked me to pay fine for travelling without ticket or asked me to get down the next station. It was mid night and I was short on cash in hand. I got down the next station and waited till next day morning and took money from ATM and took a bus home. After coming home I checked my IRCTC account and it appears that my brother has correctly filed TDR for his name alone and I was still having a valid ticket. I can only imagine that the TTE in a hurry or carelessly should have got the fact wrong. Because of his negligence I suffered severely. His attitude towards me around fellow passengers was mean. He ill treated me. I felt ashamed and humiliated in front of other passengers. And the hardship I had to go through that is unspeakable to me.

Now- I knowing that I was not at fault I want to sue Indian railways. Do you think I have a valid case here?

Is yes whats next. Should we send a legal notice?

If not, please tell me what best can be done.

Subject to the TTE explanation, you certainly have a valid case against the Railway authorities. You can file a Consumer Compliant or a Claim before the Railway Claims Tribunal.
