Legal Question in Consumer Law in India
Sir,
My ex-employer gave me a cheque of 1 lac towards my incentive dated 31st. January 2013. He requested me not to deposit until he gives a go ahead, towards the mid of April he said not to worry he would give cash or issue a fresh cheque.Today after 6 months he is refusing to pay cash of issue a fresh cheque.
Please advice.

Dear Sir / Madam,
The validity of the incentive cheque has expired on 30th April, 2013. It is pertinent to mention that you ought to have deposited the cheque prior to 30th April, 2013, so that had it bounced, you could have filed a case under Section 138 of the Negotiable Instruments Act, 1938. Now, the only recourse that you have is to lodge an FIR against your ex-employer in the local Police station to recover the amount of the cheque.
