Legal Question in Credit and Debt Law in India

Can I file a criminal suit 420 and 406 if I lend money for early repayment of housing loan to a childhood friend two thirds through cheque but have no written proof as to the purpose of the loan? And some little amounts for her various family needs. After returning one fifth she stopped returning me money. The money she returned she deposited in my bank account by way of cash. Three deposits were made through cheque as well.

She never fulfilled her promise of repaying the full amount after she or her relative sole off their agricultural land.

Though she showed me her house and the brochure and talk about her inability to repay the EMIs, she never really showed me the house papers or even the home loan papers or the fact she made early repayment of the home loan.

Now she doesn't pick up my phone or any other friend's. She lives in a town in UP while I stay in Gujarat another state. I got to know she had borrowed money from several others several years back and never it back. She even left her hometown and shifted to another town.
