Legal Question in Credit and Debt Law in India

I gave a sum of rupees 4 lakhs and thirty thousand to a friend(3 lakhs for admission and 1.30 lakhs for fees) to admit me in a college for MBA in bangalore. After when i joined the college, 6 months later my admission was cancelled because our university closed down, college refunded our fees money, at that time i got to know that there was none money to be paid for admission, only the fees had to paid i.e(1.30 lakhs), when i asked my frnd about this, he said college has taken all of the money, i dont know anything about this, and after that i used to call him, he never used to respond and put the phone on switch off, its been a one year now, recently i called him and told him to meet me, we have to clear some things, he refused and again put his phone switched off, i have not filed a police complaint yet, i told him i will file a case against u, u vil be summoned by the police, he didn't care, told me to do whatevr i want to do, plz tell me what to do, (do i have to file a police complaint first or can i directly file a legal case with the help of lawyer) and drag him to court, plz help me, thank you

Dear Sir / Madam,

I have already advised you earlier that "You can either have a friend or you can have his money. You cannot enjoy both." You have to lodge a Police complaint to resolve the matter with your friend.
