Legal Question in Credit and Debt Law in India
While joining my previous company, I got an iPad as joining bonus and I had to sign a contract stating "on separation before 1 year from the date of joining, the employee must pay the company 30000 INR as cost for the iPad". I left the company after 7 months with proper notice. Now they are charging 35000 as iPad cost + taxes for the iPad as it was added to my salary payroll. In the contract, there was nothing written related to the tax. What should be my legal steps?

Dear Sir / Madam,
Had the Company arbitrarily and voluntarily given you the iPad for office use, without you having asked for it, on separation and your leaving the Company, you are legally bound to return the iPad back to the Company. So if you still have the iPad given to you by the previous Company, simply go and return the iPad back to them. Even if you are to bear any costs from your pocket for leaving the Company before completion of a year, the Company can at the most recover a pro-rata amount of Rs. 12,500/- (Rupees Twelve Thousand Five Hundred Only) towards the cost of the iPad for the five months duration of employment, not served by you in the Company, and not Rs. 35.000/- claimed by the Company. You should go and sort out the matter with the Company.
Regards,
