If we have sent legal notice to proprietor which being wrong date written on cheque is it possible to file summery suit against proprietor.

Dear Sir / Madam,

Yes, you will have to file the same notice under Section 138 of the Negotiable Instruments Act, 1938 quoting the correct date and other particulars.
