Can a person against whom a civil suit has been filed, for borrowing money from a friend through Cheque receipt and not returning it, go out of India on Visitor Visa or Permanent Residence?

1) Yes.
2) If u have doubts of his absconding, then u hv to bring the facts
to the notice of the court where the case is going on and to prevent
his going out of India.
3) The court will examine the merits and issue orders to permit him
with some conditions as may be necessary.
