Legal Question in Credit and Debt Law in India

Query: A person claiming to have AC provider and installation services took Rs 20,000 as advance from me to install 4 AC's. Total contract was Rs. 40,000 of which I gave him 20,000 advance. It's been 5 months now and niether he has installed nor returned the advance money. He keeps giving excuse as he is out of town or mother is sick or something else. I have all the phone recording and whatsapp msg regarding my conversations with him. What should I do recover my money back from him. I know where his residence is. What are my legal rights and options. Please advice. Thanks in advance.

Dear Dhiraj,

You should try one last attempt at telling the person to either instal all the 4 Ac's as agreed, else to refund your money back. Give him three days time to complete either of the tasks, failing which, you should lodge an FIR for cheating against that person in the nearest local Police Station and seek their assistance in promptly resolving your matter. Please repost query if there is no Police action within 3 days of your lodging the FIR.
