Hi All

i have one question in istagasa when majestrate have noticed us then should i take bale before appearing in his court if all istagasa is fake

In a complaint case (Istighasa) if the court considers a fit case to proceed against the accused person, it may issue summons or warrants against the accused to cause his appearance (see Section 204 of CrPc). The accused to whom summons are issued per se is not required to obtain bail, however, the court, on his appearance, may require him to file bail bonds, if the considers it necessary to ensure appearance of the accused (see Section 91 of CrPC). Now as you have only received Summons (i.e. Notice), you are not required to obtain bail when you will appear before the court. (However, more clear opinion can be given only after looking at what document you have received from the court and what charges have been pressed against you). I suggest you hire a criminal lawyer as early as possible, so that he may formulate a good defence case for you. The law previously was that you were only required to file bail bond as you appeared on notice in complaint case.But if the magistrate is aware of the new law he will require you to file bail application which would be decided in the same manner as bail application is decided in F.I.R case.For any further assistance you can email at

Dear, if u have received notice or summon. then u have to appear in that court, on the date as written on the notice, and the lettr u have received is warrant of arrest, then on the date of appearance u wull have to submitt the bail bonds of the value sought by the court. And if the charges pressed against you are non-bailable then you have to hire an advocate to proceed in that matter.
