it shall be competent for a magistrate to take congnizance of a private complaint, when the return by the bank of the cheque bears an endorsment of nay of the contingencies or eventualities other than the ones mentioned in section 138 of the negotiable instruments act

Yes, magistrate is competent and empower to take congnizance. On dishonouring of cheque for any reason whatsoever attracts filing of complaint under section 138 N.I. Act and on filing of complaint magistrate can take cognizance.
