can a criminal appeal be withdrawn?

hello lawyers,

A case under s 302 result into acquittal. There was no appeal from the opposite party but the state preferred an appeal. Now both the parties want the state to withdraw appeal and ready to accept trial court judgement . Can this appeal be withdrawn ?

an offense under sec 302 IPC is not compoundable. So the appeal cannot be withdrawn by the state even if both complainant and accused agree to accept the trial court judgment.

No, 302 is non compoundable ,cannot be withdrawn.
