Legal Question in Criminal Law in India
in a criminal case firstly there was arguments in court. the opposite counsel offered amount of Rs5 lakhs as settlement thru mediation process. the judge passed order for mediation. the opposite counsel has requested that investigation be on hold till mediation is in progress.
my query is :
Question 1.
the Rs 5 lakhs was offered by the opposite counsel in open court so can i record the statement made by filing affidavit or application.
in case the Question 2
can my counsel record the statement made by filing affidavit or application.
Question 3
if the accused party is not serious (which he is not) on the very first day of mediation how do i request for resuming the investigation and ending the mediation progress? is it by filing affidavit, application then to whom and how?
since i believe that the motive behind the mediation may be to delay and prolong the investigation.
kindly advice.
