Legal Question in Criminal Law in Pakistan

Dear Sir, please help me that i have pay amount to my school friend(he is lawyer) for my colleague to send abroad, but after 2 attempts he culd no go abroad. i ask my friend that plz return our money, but he did not and after 2.5 years effort we put an application against him in FIA., in response he execute an Istagasa against both of us. now we are on interim bail and still he did not come in the session court since last 6 months and our bail is not becomimg confim as Judge sb said ,untill the MUSTAGHEES come we cannot write any orders. In the FIA he is coming for interim bail. plz guide me what should we do or what step we take against him.
