Legal Question in Criminal Law in India
A defamation suit u/s 500 has been filed against my mother before the Metropolitan Magistrate's Court. The Complainant did not serve any notice to my mother. Is it compulsory to serve a notice to the accused before filing any complaint for defamation. Can my mother file a revision before the Sesssions court u/s 397 of CrPC on the grounds that she was not served a notice?

serving a legal notice is not madatory for defamation this ground will not help your mother.
