I took a deposit for a catering job and was unable to handle the job. I was more than willing to send the deposit back. The woman went to the police instead to bring charges against me for theft and Check fraud. It was one week.

Just breaching a contract isn't a crime. If you intended to do the job when you accepted the check and when you deposited it, then you're not guilty of the charges you've listed. The circumstances could make you appear guilty, though. Police and prosecutors have no special access to the truth, so you could be in trouble even if you're innocent.
You also run the risk of civil liability. Whether you're liable, and for how much, will depend on the facts. You could owe a lot more than the amount of the deposit.
