A 161 statement is taken by a police oficer from a witness or a complainant. It need not be signed. It may be recorded on a audio video mode or device.
A164 statement is a confession of an accused, which is voluntary, maybe on oath. It is always recorded by a Magistrate and may be recorded on a audio video mode or device.
