MY father was interested in purchase of a property but these peaple cheated my dad and taken 20 lac from my dad.now my dad to file a case for 420. the police refued to file this case .now we move to court but the MM also not doing any good and each time he gave a next date of hearing and no order have been passed by MM to lodge an FIR what should we do . my dad is an old man and at the stage of retirement from air force.

did he file an application u/s 156(3) along with his complaint for lodging an f.i.r. along with f.i.r., he may also file a suit for recovery of his money. i would like to go through the contents of the complaint for suggesting better.

what is the cheating in the transaction? If they agreed to sell the property and have not sold after accepting 20 Lakhs, and you are ready and willing to buy after paying the balance considertion, then your remedy is to file civil suit for specific performance. If you do not want to purchase now, your remedy is to file suit for recovery of 20 Lacs along with damages for your losses
