Legal Question in Criminal Law in India
That i have filed case u/s 138 of Negotiable Instruments Act against a person, said case is for evidence stage. Now said person has filed private complaint u/s 420,406,409,465,467,471 of Indian Penal Code, mentioning that he had given only blank signed cheque, and we filled amount on it and deposited it in our bank without any prior intimation to him. Whether his private complaint is maintainable or not.
