i have flat along with car parking area registered in my name.i bought a car 3 months back.i reside on the 1st floor of the bldg. .The CAR PARKING SPACE of person residing on the third floor is behind my space. He disturbs me at odd hours to take out my car so that he can drive in/out his car. There are two other exit/entry gates which he can easily use without disturbing me.but he will not do that.i approached the local samity giving an application requesting them to interfere and settle the matter amicably. They visited the place asked him not to disturb me. i am a single lady living alone with my small child 3yrs old.after that 2 months passed .then suddenly one day samity called me and that person ,instead of helping me they started to hackle me along with that person.they threatened me with dire consequenses if i don't give in .i was terrified and approached the local thana for help.i lodged a general diary reporting the matter.the policemen suggested me to go to the court. pl help? what shall i do? shall i file a criminal case ,then how?pl suggest.is sec 107 & 144 suitable?
1 Answer from Attorneys
1) First find out from the bye laws as to how the other person has to exit.
2) If u are right, then file criminal case against that trespasser for creating
nuisance and disturbance intentionally to harass u and bring restraint order
against him.
3) Consult a local experienced lawyer who will explain the rest.
