Legal Question in Criminal Law in Australia
a friend of mine has plead guilty to stealing $68,000 from her employer over a 12-18 month period. she has also plead guilty to 10 associated charges. she is 21 years old has no prior offences, she is now on $2000 bail and $2000 surety. she must report to police once per week and will be sentanced at the end of January. i would like to ask what are the chances she will be sentanced with prision time?
1 Answer from Attorneys
The chances of staying our of prison will be greatly enhanced by her entering into a repayment plan for the amount defrauded or, even better, by repaying the entire sum. They will also be enhanced by her addressing any underlying issues that contributed to the commission of the offences eg gambling, counselling, drug counselling etc and presenting evidence of that counselling to the court at her sentencing date.
