Legal Question in Criminal Law in India
High court of Patna Direct the SDJM court to send the accused on Police remand in 498a and ask him why he did not surrendere in the court? where was he living and who have sheltered him. Registered a case of absconding against him and the rest those who helped him in absconding. Police did not come to take remand even after passing two months and 17 days. Boy is in judicial custody since last three and half months and facing trail, his wife also presents there. He has also paid full arrear amount of Maintainance and his parents are still paying each and every months installment to the wife. Now he has applied for regular bail but what will be the answer that why police have not complied the high court order? And without compling that order how can he get regular bail

non compliance of an order by the second party is their issue you must proceed with the remedies available to you .
you should file the Regular bail.
it is their duty to comply the order.
Rest they may ask you the same query in court also. so be ready for that.
