Legal Question in Criminal Law in
whether a mortgage property under mere depositing title deeds and when that property is sold without any ill intention without the knowledge of the mortgagee does it amount to cheating ?

u haven't mention whether mortgager and seller are the same person,if they are same then it is cheating, if not then knowledge reqired proof.

it is cheating. the transaction is otherwise not valid unless you have attorned the mortgage.
