So most of the criminal must using this method to cheat innocent people.
But insolvency is different from 138 NI Act, he is still liable to creditors cant he be punished under 138 NI act?
I have emails from him saying he has done huge investments in other places (Before he bounce cheque), his kids are going to very big school (among most costly school in our place) can it be used against him, saying he is hiding his assets.
And IP is filed after cheque bounce so, this is done on purpose and he had intentions to cheat and then can we file 420 ?

Has he gone insolvent legally............???
has court considered him insolvent and has he made paper publication for his getting insolvent ...........if no then yes you can get him and recover you money under NI act itself...........
