Legal Question in Criminal Law in India
One Mr. Shivkumar(SK) filed criminal case against three brothers for fighting and killing threatening after court order u/s 156(3) for event on 1.8.2009. SK has produced before Police a medical report dated 1.8.2009 prepared by clerk but the medical report is countersigned by Medical Superintendent on 30.12.2009.
On the basis of Med. Supdt. signed on 30.12.2009 can three brothers defend the case proving the report as false and frivolous.
Please give us your valued suggestions.

The MS may have certified the report. without seeing the document cannot say if the same is false or frivilous.
