Can Non Bailable Warrant can be cleared without the presence of the accused..when the accused is absence for apperence and failed to file a 317 petition.

for NBW the accused has to come to the court for the cancellation of the warrants but this he may do before the date of hearing in the absence of the complainant also.

No, one may apply for cancellation of NBW in absentia also. there is a judgment of Delhi High Court in support. Prem Cashew Industries versus State by Hon'ble Mr. Justice Sodhi
