Legal Question in Criminal Law in India
It has been ordered by lower court under section 125 that I need to pay rs. 15000 as maintenance to my wife.now I want to file divorce case. I have heard that during pendency of the divorce case husband has to pay interim maintenance to his wife. My question is that if it is so than I need to pay both maintenance simultaneously I.e. U/s 125 & interim maintenance? Or it will get merged?

generally you need to pay the high amount of maintenance granted by either court. if interim maintenance in divorce case is 10k, then you would be paying 15k granted in 125.
