Legal Question in Criminal Law in India
If a person is convicted and sentenced by Magistrate of First class under Section 406 IPC to imprisonment for 2 years and a fine of Rs.2000/-
How will be the sentence in default of payment of fine be calculated? Will it be calculated on the substantive sentence of 2 years(imprisonment awarded) or on the maximum which the magistrate is competent to impose for the offence(3years)?

It is for the jail authorities to make calculation as per their Manual.
