Legal Question in Criminal Law in India
A is a person who is missing from dated 0/01/2000 and his report of missing 04/01/2000 is registered with police. B is the wife of A and C & D are the children of A & B. Now, B, C & D (all family members of A) died in 2002.
My question is:-
According to the Indian Law, a missing person is assumed to be dead after 7 years and his (A) property can be transferred after 7 years. Now the question is which date will be considered for transfer of property (i.e. date of missing or date after 7 years).
I have examples of Insurance companies that you can give benefit after 7 years of a missing person but date will be considered from missing date.
Kindly give your views.
