Legal Question in Criminal Law in
If the police happen to take you to a police station on the grounds that you were in a car with some friends at around 3 in the morining in a deserted area...can they lodge an FIR against you? The situation is this: 2 guys and 2 girls are in a car, and there's no evidence of alcohol, drugs, etc. However, if the police frame charges, insisting that the 'offenders' were found in an objectionable position, etc.. is this substatial enough to book a case? And what happens when 2 members (the girls) are let off, on account that they are students of a university, and are handed over to the administration of the university...can the police still come say, 3 days, a week, or a month later, even to take them to the police station and lodge a complaint when initially no written statements, photographs, etc. were taken? How far can the police go in this regard? And is it possible to frame charges against only two members and let the other two go?

though the police may register the FIR but if they can explain the reasons for causing delay otherwise delay will be in your favour. Be as that it may, matter will have to be contested or quashed by the high court
