Sir, that would depend upon the facts of each case and the circumstances under which one is declared Proclaimed Offender (PO). One has to see the orders passed from time to time seeking presence of the accused. Whether the accused had notice of the case or not. Was it based on actual or constructive notice. was it personally served or served on some one else initially. There cannot be any standard set answer.

An application to set aside the Proclamation has to be moved with the concerned Magistrate.
