Legal Question in Criminal Law in India

Most Respected Sir please it is my last question on this issue:

sir i am bank employee in year 2007 april bank logged case against me in sec ipc 406 with police and suspended me. bank done departmental enquiry and after that restated me in year feb 2009 after deducting my two increments. in between police also done as you know police enquiry it is against me and police file chargesheet against me in year 2008 in court. now my question is that court take any action against me at any time or now it is useless. i am in bank and working my job after departmental enquiry when bank restated me after that bank not put any question to me on that matter. under sec ipc 468 it is useless or court take action.

Please guide me sir.

Your case in the Court is time barred and invalid as per the Indian Limitation Act, 1963.

as you told me that my case was time barred and invalid so sir it means i have not to worry on this matter sir. please guide me or i have to wait for further action from court. or now court not take any action on this.

Dear Sanjay,

Yes, you do not have to worry any more on this matter; simply forget the past, and concentrate on doing your bank job to the best of your ability.

file quash petition in high court against FIr and get the case quashed under section 482 crpc the case is strong say u were reinstated and charges wre were useless and department reinstated you.

Since the bank has reinstated you and has already penalized you then now you can file a discharge application before the court as the charge sheet has been produced and no charges are yet framed. The court may discharge you or close the trial as per s.258 Cr.P.C.

there is any need to do this me as mentioned above or as you asked forget the past and do ur job. sir i pray you please guide me at any stage i not want any problem so please help and guide me. Now no one can do anything against me sir or can do at any time. I not want to do anything. if i simply sit silent then at any stage any thing happen or not at the time of retirement also.
