Legal Question in Criminal Law in India
Respected Sir
I just wanted to know the following from your goodself.
1. I am the real wife of my husband .I have voter id,Ration Card, also my name listed in the local panchayat and I have also got the 125 CRPC order of Maintenance as wife from My Husband. But my husband has cheated the Central Govt. University and has given the name of any other lady as his wife in his service record which I have got the information through my rti application. I wanted to know May I lodge an F.I.R. against my husband for doing this forgery with me and giving the false information in his service record and also may I lodge F.I.R against that lady for presenting herself as the real wife rather than having no evidences as she is the real wife.
2. If yes, under which section of indian penal code should I lodge the F.I.R against my husband and that lady who is claiming to be his wife but in reality she is not the real wife.

Yes, you can lodge a complaint against both of them. Its a cheating both against you and the govt. department. Also write a letter to his department while annexing those proofs. You need not think about the section. Police will itself decide the section. Secondly, if others lady name is in govt. document,it means he must have married that woman. In this case, a charge of bigamy will also be framed against him.
