Legal Question in Criminal Law in India
Sir my share in property has been transferred by putting forge signature on partition document (unregistered) in the year 2003. What step we should take to stop other party?Can we go for criminal proceeding? What steps should be taken?

Yes Sir, you may file a criminal complaint before the police giving the details of the document, properties which have been partition, true deceased owner, whose signature have been forged etc. and requesting the police to register a FIR, investigate and take action in accordance with law. Police must register the case. However, if for any reason the police does not do so, then file a complaint before the Magistrate of your area, under section 156 (3) Cr P C seeking direction to the Police to register the case or else the magistrate will inquire into the case and summon the accused persons who have allegedly committed the forgery.
