Legal Question in Criminal Law in India

Hello Sir,

we need your advice- My sisters husband and inlaws torture my sister for dowry, they beat her for that. She does not want to destroy her merrige thats why she hasnt complaint about that. they beat her and threw her out and she came back at her parents home. when we were in discussion to lodge an FIR.

Her husband has filed case under section 9, full of alligations and cruelty (based on false facts).

after that my sister has lodge FIR under on her husband and inlaws under 498A, 34.

NOW MY QUESTION IS --

As they have file case under section 9 prior to the FIR of 498. will they get benefit of that ?

Her husbands advocate is saying that 498 is after thoughts as we have file section 9 case first.

what should we do to get justice for my sister ?

please help---please advise
