I sold a motor bike in 2009 sale deed written on plain paper witnessed by two persons. I have handed over Rc book & insurance along with transfer papers

to buyer as per deed responsiblity of ransfer job is of buyers.during the cource of transfer the file at to office misplaced transfer process could not be completed in the mean time the purchacer died & bike was in possession of deceased family. In Jan 2014 I came to know the bike got accident with tractor .pillion rider died in this incident. Bike was not insured what are the legal consequences for me

Dear Client,

As per the prevailng law the owners name that is appearing on the RC on the date of accident is the owner of the vehicle, the owner is liable to compensate the third party injured if there is no insurance as on date of accident or against the terms and conditions of policy. The agreement duly signed by transferee and witnesses is not going to help you in any way. Instead as a last resort you may contact some staffs of the RTO office and request their help in locating the RC that was submitted for effecting transfer, even a receipt issued by RTO on receipt of RC or its copy or extract can save you.
