Legal Question in Criminal Law in India
Can my son, who is my Power of attorney holder, appear and argue on my behalf before the Metropolitan Magistrate in case wherein I am the accused?

accused has to appear in person. son or power of attorney cannot appear on behalf of the accused. however, there is provision for exemption of the accused from appearance for which an application will have to be filed stating reasons for not appearing.
