Legal Question in Criminal Law in India
My wife filed a false 498a Fir case against me.Also my father in law filed a false 506 IPC case against me,I have filed a counter fir against it.Regarding both cases,I got AB and appeared before police daily and got relaxation from High court.Also as per High court orders for 498 a case,I have surrendered my paspport before local court (as I am being NRI).In Both cases,Police has filed chargesheet before trial court(as per Police website FIR status details),but we are not receiving any summons from the court for appearance?My doubt, Now I am in position to join back work abroad because of my housing loan 50K per month to pay(Financial crisis).How to get back my surrender Passport from the court?What are the other possibilities,opponents(my wife's lawyer) try through court so that I can't leave India for Job abroad?

you need to file an application for release of passport before the concerned magistrate and in case the application is declined, you may approach the High Court.
