Legal Question in Criminal Law in India
A woman neighbour spat on me after I told her politely to close the society gate. If I complain to police, I am afraid that she might make a false molestation case against me and police may arrest me without proof. How do I complain about her spitting without getting entangled in a false molestation charge? If I apply the spit back on her face to prevent her from spitting at me in future will I be charged or will it be considered as an act of proportionate self defence? There is no CCTV footage to prove the spitting by the woman.
