Legal Question in DUI Law in Canada

If a US Citizen who is a licensed New York State driver has been charged with a DWI in Ontario, Canada would they still be able to legally drive in New York State? The New York State License was confiscated by the Canadian Police Department. The person has not been convicted and this is a first offence. The person is over 21.

Police were likely within their authority to confiscate the license and then return it to the state agency in New York. The driver may not be able to drive in Ontario for 90 days. The consequences of a conviction in Ontario may result in a New York suspension. Ontario and New York have an agreement to share information.
