I have 2 children aged 2.5 and 6 years, both boys are living with their father as for some reason, I am unable to take custody, I am living with my parents after the dispute (since 4 months). from 4 months I couldn't meet my children as my husband does not allow it. my questions are.
1 -For visitation, what maximum I can get through court.
2- how long it will take
3- during the case can I meet my children
4- what will the expenses

2.5 old child must be with you. You can get custody easily through court with min time. Second one 6 year you have good chance to get his custody. It will take min time. 1 & 2. If you simply want the right of visitation instead of full time custody then After first appearance of your husband before the court you will get the visitation rights. And otherwise in such situations we invoke the sessions court power to issue the writ under S. 491 of Cr.PC and get the custody immediately.
