Legal Question in Family Law in India

2 HINDU persons got married in March 2016 in west Bengal. But their marriage is not registered yet. Both the parties are not happy with the marriage especially because of physical problem of d husband . N I'm the relative of that wife.

Now both d parties want a MUTUAL SEPARATION, without going to court. Is it possible? If yes, then how?

If they are bound to move to court for divorce, then is d 1year conditions mandatory in this case?

1) Without court, not possible.

2) 6 mths mandatory may take upto 1 year.

SC may waive cool off period.

Dear client only court has power to grant divorce. So out of court settlement has no value. For asking mutual divorce one year separation is compulsory
