Legal Question in Family Law in India

3n half year baby's mother passed away...baby living with mothers younger sister (me)...recognises me as mother... father taking baby to his place frequently for long hours.... baby's surely being abused there but not provable way.... multiple requests made to visit baby at our place instead of taking her... not agreeing.... we want that baby not be taken for atleast more 2yrs..... what r my rights and my stand if I want to file a petition.... he has not taken any practical or financial responsibility of the baby...
