Legal Question in Family Law in India

How can a 80 year old father who is abused by elder son disown him from his self made house which was declared HUF in 1984 but the Huf account opened was never used and no transaction has been made in it since 84. The son refuses to leave the house and threatens to go to courts. Pl advise.

Going to the court is not a threat rather a remedy. the court may decide the rights of everyone.

If the the property is owned by the HUF, then the son has a strong case. However the father may file 125 CrPC proceedings against the son for maintenance of the old father. This court case would surely pressurise the son and he may stop abusing the father. You may also drop a detailed query at [email protected]
