Legal Question in Family Law in India

I am 34 year lady, a divorcee have 2 kids...me and my kids suffered during my 8 years of married life. Along with me my kids also hate his father due to his aggressive abusive nature since they are kids. Now they hate to spell that man's name ever. Elder son now in middle school asks always that "I wont want to tell his name when ever anybody asks" and my kids teacher mentioned that they both use to scratch his father's name on ID card and where ever it comes. My well wishers suggested me to re marry and now had decided to whom loves my kids too along with me. I understood him well and want to keep his name in place of my ex-husband. So, how should i go legally for this. Please suggest me soon.
