Thank you for your question. First of all you need to decide whether you want to stay with your husband or not. If the situation demands then you should divorce your husband. Secondly, you mentioned that your husband is having extra marital affair with someone else and for that reason he is torturing you and your daughter mentally and physically. You should file a GD in the local police station regarding his violent behaviour inflicted upon you. Finally, subject to the availability of the evidence showing your husband is not fit for the upbringing of your child, the court will most likely give you the custody of your child once you file a civil case for the custody. Please note that according to the law your daughter is entitled to stay with you untill she reaches the age of puberty. Therefore you should consult a good lawyer to file the case for the custody of your child.
