Legal Question in Family Law in India
Adv Kamal Grover and Adv Prakash Patel have mentioned here that hiring a lawyer can force my husband to come to India. Now my question is when on Bofors case our government could not bring Quattrocchi to India then how can a lawyer force my Husband to come to India when our marriage was only solemnized in a temple as per Hindu rites but not registered and he did not touch me or lived with me and completely deserted me and did not take any dowry from me.He is holding a French passport and he is also having a OCI card and he is still single and unmarried in his country. He is not coming to India and not ready to give alimony and he only says our marriage never existed and i should forget him.
Please help and give me a solution instead of advising to hire a lawyer.Yes i am ready to hire a lawyer but i need to know first does it really help and what can a lawyer really do in this case.

In case nbws are issued against your husband and he does not appear before the trail court a petition can be filed for extraditing him from the answering country provided there exists a treaty between india and the answering country. It is the lawyers only who can help you in this situation. you may go through this link where colleague Mr. Adv. Rajiv Gupta got the favorable orders.

Dear client,
India has signed the extradition treaty with Franch in the year 2003 and therefore, if the Courts in India would ask for the extradition of any person in India then the Embassy of that country has to send that person to India.
