Legal Question in Family Law in India

My brother got married in may 2013. After the marriage girl did not come to stay with my brother. She came in December 2013 and went back to her parents in April 2014. From then they are staying separately. My brother wants divorse from her but she is not willing to give and herself and her dad are saying that they gave 32 lacs at the time of marriage which they never gave. Day to day it became tension now. Can we file a case on her? If so under what sections we can file a case for divorse? Now she says she want to stay with my brother but my brother don't want to. They don't have kids.

The only ground available is cruelty. Whether the conduct of wife amounts to cruelty or not can only be analysed by looking at the whole facts. Don't rush.
