Legally, there is no age factor, as such, in custody matters. The courts look into welfare of the minor and grant custody to the party where, according to the court, welfare of the minor lies. However, normally, unless there are adverse reasons, the courts consider that until age of 7, it is in welfare of the minor to stay with mother.
