my daughter left the hushband's house for 2 yrs,left daugher of 3 yrs with my son in law

we do not want child custody & my daughter is not physical well to take care of her daughter , who is responsible for child custody?

If the mother doesnt want the custody of the child then the father will get the custody. If he too doesnt want the custody he can give the child in adoption.

Ms. Anuradha is right.

In this situation, even being a NANI you can also demand the custody or husbands parents can also keep the child.
