Legal Question in Family Law in United Arab Emirates

Dear Law Guru,

I am a HINDU lady married to a HINDU in Dubai. We have to file for divorce, but i have a 20 month old boy. I am not interested in any money/settlements from my husband. All i want is custody of the child.

FYI, Father has already been divorced once. Also his brother and sister have been divorced.

Can this happen in Dubai?

Hi,

As both of you are Hindu by religion and presuming the Marriage to have taken place as per the Hindu Customary religious practices, if it is acceptable to both the parties, the Divorce case by mutual Consent as per the Hindu Law can be filed before the jurisdictional Court at Dubai. The advantage being that the process is quite faster over here. Custody of the Minor child would be as per the due process of law and depend on the contentions putforth by your Husband.
